("Skillful Lover," "we," "us," or "our").

3. Intellectual Property Rights

  • Our Content: The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Skillful Lover Inc., its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
  • License to You: Upon your purchase of or enrollment in a course, Skillful Lover Inc. grants you a limited, non-exclusive, non-transferable, revocable license to access and view the course content for your personal, non-commercial, educational use only. You agree not to reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course content unless we give you explicit permission to do so in a written agreement.
  • User Content (If Applicable): If the Services allow you to post comments, reviews, or other content ("User Content"), you retain ownership of your User Content. 5. Payments, Subscriptions, and Refunds

  • Payments: To enroll in paid courses or access certain paid features, you must provide valid payment information through our designated payment processors (e.g., Coinbase, Braintree). You agree to pay all fees and applicable taxes incurred by you or anyone using an account registered to you.
  • Pricing: We may change the price for courses or subscriptions from time to time. Any price changes will be communicated to you in advance.
  • Refund Policy: We stand behind the value of our "Skillful Touch" mini-course. If you purchase the full "Skillful Touch" mini-course and are not completely satisfied, we offer a 7-day, no-questions-asked money-back guarantee from the date of your purchase. To request a refund within this 7-day period, please contact us at support@skillfullover.com with your purchase details. Refunds will be processed to the original payment method within a reasonable timeframe. This refund policy applies only to the initial purchase of the full "Skillful Touch" mini-course and does not apply to any future courses or services unless explicitly stated otherwise for those offerings. No refunds will be issued after the 7-day period has expired, except as required by applicable law. The free trial lessons are provided at no cost and are not subject to refunds.
  • Subscriptions (If Applicable): If we offer subscription-based services, the terms of those subscriptions (e.g., billing cycle, renewal terms, cancellation policy) will be presented to you at the time of purchase and are incorporated into these Terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SKILLFUL LOVER INC., ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Skillful Lover Inc., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content (if applicable), any use of the Service's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Services.

9. Termination

  • By You: You may terminate your account and request deletion of your personal data at any time by navigating to your 'Settings' page within your Skillful Lover account and clicking on the 'Delete My Account' button, or by contacting us at support@skillfullover.com.
  • By Us: We reserve the right to suspend or terminate your access to all or part of the Services at any time, with or without notice, for any reason, including, without limitation, if we believe you have violated or acted inconsistently with the letter or spirit of these Terms.
  • Effect of Termination: Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of, or related to them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of Delaware, United States without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

  • Waiver: No waiver by Skillful Lover Inc. of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Skillful Lover Inc. to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
